Terms and conditions of use
QIOZ is a web platform, accessible at https://www.qioz.fr (the "Site") operated by the Ile-de-France Region, with registered offices at 2 rue Simone Veil, Saint-Ouen, France (93400) and with SIREN identification registration number 237 500 079. The Site’s purpose is to make available, free of charge, a platform for learning foreign languages (English, German, Spanish, and French as a foreign language) to all Ile-de-France residents over the age of 15.
The purpose of these General Terms and Conditions of Use (the "Terms") is to define the terms and conditions governing the relations between the Users (as that term is defined in Article 1) and the Ile-de-France Region. These Terms constitute a contractual agreement for an indefinite period, commencing with the acceptance by the User of these Terms.
By clicking on "Sign Up" at https://www.qioz.fr , the User acknowledges having read the Terms and agrees to be bound by these provisions. Minors who have reached the minimum age of 15 are allowed to register on the platform, provided they have previously obtained, from the holder (s) of the parental authority concerning them, the authorization to do so and that the holder (s) of the parental authority has (have) accepted to be guarantor (s) of the respect by the Minor user of the General Terms and Conditions of Use. Any use of the services available on the Site by a Minor user who has reached the minimum age of 15 is carried out under the full responsibility of the holder (s) of parental authority over the Minor user concerned.
No special conditions may, except with the formal and written acceptance of the Ile-de-France Region, prevail over these General Terms and Conditions of Use, ruling out the application of Article 1119 paragraph 3 of the Civil Code. No waiver of the benefit of any provision of these General Terms and Conditions of Use shall be valid without a written and unequivocal statement from the Ile-de-France Region.
Article 1 - Definitions
Except as defined in another section hereof, capitalized terms and expressions used hereafter have the following meanings:
∙ Service (s) means the free availability of the foreign language learning platform.
∙ "User" means any natural or legal person using the site.
∙ Password: The "password" is confidential information, which the User must keep secret, allowing the user, conjointly with his or her username, to prove his or her identity.
Article 2 - Operation of the Site
2.1 Eligibility for the Service
To be eligible for the Service, the User may be a natural or legal person. If the User is a natural or legal person, he or she must have full legal capacity. Minors who have reached the age of 15 must obtain permission from the holder (s) of parental authority to accept the Terms and Conditions of Use.
2.2 Creation of an Account
In order to access the platform, the User must create a user account on the Site https://www.qioz.fr by creating his or her username and password, or via a LinkedIn connection. The User then enters his or her login details (username, password, e-mail address, IP address at the first connection), his or her postal code, age group, socio-professional category, sector of activity, language proficiency level, and his or her motivations for learning, providing accurate and up-to-date information.
At the end of the account creation process, the user receives a hypertext link that allows the activation of his or her account. In the absence of activation, the process of creating the account is not interrupted, but the User receives a reminder via email inviting him or her to activate the account.
Each User agrees to create only one account corresponding to his or her profile.
User account access codes are strictly confidential. In case of unauthorized use of his or her account, or any breach of the confidentiality and security of his or her means of identification, the User must, without delay, inform the Ile-de-France Region.
All hardware and software necessary to access the Site, as well as the use of the Services, remain the exclusive responsibility of the User.
In order to ensure the proper functioning of the Site, it is specified that the Website is optimized for:
∙ All screen resolutions;
∙ The latest versions of the Internet Explorer, Chrome, Firefox, Safari and Opera browsers;
∙ Responsive use on smartphones and digital tablets.
The QIOZ platform is accessible via an Internet browser on any electronic communication medium such as computers, tablets and smartphones.
The Ile-de-France Region reserves the right to take any measure it deems appropriate against any User who contravenes, according to the Region, the provisions of the legislation in force or these General Terms and Conditions of Use. It can suspend, modify, replace, deny access or delete user accounts.
2.3 Validity period of the account
The User account is active for a period of two years.
In the absence of a log-in for a period of twenty-four (24) consecutive months, the Region-Ile-de-France will send the User an e-mail notification of closure, warning him or her of the imminent inaccessibility of that account within forty-eight (48) hours and the anonymisation of his or her data. If the User does not perform at least one login during that time, his or her account will be deleted.
If the account is deleted, the User must create a new account, under the conditions provided in article 2.2 of these General Terms and Conditions of Use.
The User may request the deletion of his or her account at any time by sending an email to the following email address: dpo@iledefrance.fr
2.4 Operation of the Service
The Site and access to the Services are made available free of charge.
The creation of an account allows the User to access a personal space in which he or she will find the following information:
- The language level obtained at each passage of the level assessment test;
- His or her learning path, the learning activities carried out, and those still to be done;
- The total time spent learning, and time spent on each activity;
- The results obtained for each learning activity;
- An indicator of his or her progress;
- The learning units marked as favorites, including educational activities or units proposed by the platform according to the learner’s results.
In order to access the Service, the User agrees to receive learning follow-up emails that will enable the personalisation of his or her learning path.

The User, if he or she agrees, can subscribe to the QIOZ newsletter. This newsletter, sent periodically by email to subscribers, summarizes the latest news on foreign language learning offered on the Site.
2.5 User Obligations
The Ile-de-France Region, in accordance with these General Terms and Conditions of Use, grants Users a limited, revocable, non-exclusive, and non-transferable right of access to the Services on a strictly personal basis.
Any use of the Site contrary to its purpose is strictly prohibited and constitutes a breach of these provisions.
Users are forbidden:
1. To transmit, publish, distribute, register or destroy any material, in particular the contents belonging to the Ile-de-France Region, in violation of the laws or regulations in force concerning the collection, processing or transfer of personal information ;
2. Create fictitious profiles;
3. To provide inaccurate information on the registration form or not to update it regularly;
4. To disseminate data, information, or content that is defamatory, abusive, obscene, offensive, violent or inciting violence, or of a political, racist or xenophobic nature and, in general, any content that would be contrary to the laws and regulations in force, or of a high morality.
5. To reference or create links to any content or information available from the sites of the Ile-de-France Region, except with the specific, prior written agreement of the Ile-de-France Region;
6. To obtain other Users' passwords or personal identification data;
7. To use information, content or any data present on the Site in order to offer a competing service to the Site;
8. To sell, exchange or monetise any information, content or any data contained on the Site or Service offered by the Site, without the express written agreement of the Ile-de-France Region;
9. To reverse engineer, decompile, disassemble, decipher or otherwise attempt to obtain the source code in connection with any underlying intellectual property used to provide all or any of the Services;
10. To use any software, manual or automatic device, robot crawlers, or other means to access, explore, extract or index any page of the Site;
11. To endanger or attempt to endanger the security of a website in the Ile-de-France Region. This includes attempts to control, scan, or test the vulnerability of a system or network or to breach security or authentication measures without express prior permission;
12. To forge or use the products, logos, trademarks or any other element protected by the intellectual property rights of the Ile-de-France Region;
13. To simulate the appearance or operation of the Site, for example by creating a mirroring of it;
14. Disturb or interfere with, directly or indirectly, the Ile-de-France Region or the Services, or impose a disproportionate burden on the Site's infrastructure or attempt to transmit or activate computer viruses via or on the Site
If, due to extraordinary circumstances, a User is not able to fulfill his or her obligations, the latter undertakes to take all necessary measures so that the reputation of the Ile-de-France Region is not damaged.
The platform is not intended to disseminate advertising data, or for the promotion of private interests, or activities contrary to the maintenance of public order or anything deemed illegal.
As a reminder, violations of system or network security can lead to civil and criminal prosecution. The Ile-de-France Region checks for the presence of such violations and can call on the judicial authorities to bring legal action, if necessary, against Users who have participated in such violations.
Users undertake to use the Site in a fair manner, in accordance with its professional purpose and the legal and regulatory norms, with these General Terms and Conditions of Use, and with current practices.
Article 3 - Intellectual Property
The architecture of the Site, trademarks, logos, domain names, software, content and any other element of this Site, without this list being considered exhaustive, are subject to protection by the Code of Intellectual Property.
The User undertakes not to infringe, directly or indirectly, the intellectual and industrial property rights of the Ile-de-France Region and its co-contractors.
Any representation and / or reproduction and / or partial or total exploitation of the contents and Services offered by this Site, by any means whatsoever, without prior written authorization from the Ile-de-France Region, is strictly prohibited and may result in legal proceedings.
Article 4 - Processing of personal data
The personal data transmitted on the Site at the initiative of the Users for the execution of the Services are used solely for this purpose. We use your data only on the basis of your consent regarding the monitoring of users' learning activity, the collection of email addresses via the Citizen Relationship Management (CRM) system, the receipt of the newsletter and the reception of an anonymous satisfaction survey. We use your data solely for the execution of a contract regarding the free availability of a foreign language learning platform for people over the age of 15.
The following data is collected and processed when an account is created to access the Service:
- Gender
- Post code
- Age group (15-25 years old, 26-59 years old, over 60 years old)
- Professional category
- The area of the activity
- Login data (username, password, e-mail address, IP address at the first connection)
- Data from third-party applications at the first connection (LinkedIn)
- The language proficiency level
- Learning motivations
- Online dashboards to analyze the performance of the device
This data is provided by Users who accept, by creating an account on the Site, voluntarily and specifically, the present General Terms and Conditions of Use and authorize the processing of the data by the Region Ile-de-France.

Personal data is stored by the Ile-de-France Region on its servers for the purpose of processing it for the provision of the Services. It is kept only for the duration necessary for the purposes of its collection, ie for three (3) years, before deletion.
In order to facilitate the use of the Site and to personalize the experience of the Site by the User, the Ile-de-France Region uses cookies and log files. These cookies are used for the proper functioning of the Site, user accounts and for the execution of the services offered. The use of cookies may be disabled by changing the settings of the internet browser.
All appropriate technical and organizational measures are implemented to protect personal data, including encryption, anonymisation, and the implementation of physical security procedures. Strict working methods for security and information protection, including contractual obligations of confidentiality, are imposed on staff and contractors in the Ile-de-France Region.
The persons concerned, in accordance with the regulations on the protection of personal data, have the right to access, rectify and delete their data, as well as the right to oppose or to limit the processing that the data is subject to. They also have the right to the portability of their data, if any. For this, it is sufficient to make the request to dpo@iledefrance.fr , specifying the user’s last name, first name and address and providing proof of identity.

Article 5 - Liability
5.1 General provisions
In any event, the Ile-de-France Region cannot, under any circumstances, be liable for indirect losses or damages of Users or third parties, which includes any missed profits, inaccuracy or corruption of files or data.
The Ile-de-France Region cannot be responsible for the delay or non-performance of Services justified by a case of force majeure, as defined by the case law of French courts and tribunals.
5.2 Use of the Site
The User agrees to comply with these General Terms and Conditions of Use.
QIOZ reserves the right to refuse access to the Service, unilaterally and without prior notice, to any User who does not comply with these Terms.
The role of QIOZ is limited to the provision of User Services. The User is solely responsible for the consequences of the use of the Site. He or she is solely responsible for the preservation of his or her Login ID and password. He or she undertakes to take all measures to ensure complete confidentiality.
The User is required to ensure that the use made of the Site complies with the legal, regulatory and General Terms and Conditions of Use of the Site. QIOZ does not give any guarantee to the User as to the conformity of the use of the Site, whether as used or planned to be used, with national or international legal and regulatory provisions.
QIOZ implements all reasonable means at its disposal to ensure quality access to the Service, but is under no obligation to do so.
QIOZ cannot, moreover, be held responsible for any malfunction of the network or the servers or any other event beyond its reasonable control, which would prevent or degrade the access to the Service.
The User is warned of the technical risks and access interruptions that may occur on the Site. Consequently, the Ile-de-France Region cannot be held responsible for the unavailability and slowdown of the Services, particularly in the following cases:
- Momentary interruptions of the Site necessary for its evolution, maintenance, or more generally in the case of updating of certain files;
- Difficulties of operation or momentary interruption of the Site independent of the will of QIOZ, notably in case of interruption of the services of electricity or telecommunication;
- Failures or malfunctions of the Internet network in the transmission of messages or documents;
- Deletion, impossibility of storage, incorrect or untimely transmission of editorial content on the Site.
- Modification of the General Terms and Conditions of Use
QIOZ reserves the right to interrupt, temporarily suspend or modify without notice access to all or part of the Service, in order to maintain it, or for any other reason, without the interruption giving cause to any obligation or compensation.
Article 6 - Modification of the General Terms and Conditions of Use
The Ile-de-France Region reserves the right to modify the present General Terms and Conditions of Use at any time, in particular to comply with all legal, jurisprudential, editorial and / or technical developments.
The Ile-de-France Region will inform the User by e-mail and invite him to agree to the changes.
In the event that the User does not accept the new Terms, he will no longer be able to use the Services.
Article 7 - Termination
The User as well as the Ile-de-France Region may terminate the contract for the Services at any time by visiting the Site and following the procedure provided for this purpose.
The User will be responsible for the circumstances in which he or she terminates the provision of Services.
The Ile-de-France Region reserves the right to restrict, suspend or cancel, without notice, the account of any User who misuses the Services, or uses them inappropriately. The assessment of the User's behavior is reserved at the sole discretion of the Ile-de-France Region.
Article 8 - Agreement in relation to proof
The computer systems and computer files are the articles of proof in the relations between the Ile-de-France Region and the User.
Thus, the Ile-de-France Region may validly produce, for the purpose of any proceedings, in the form of proof, any data, files, programs, recordings or other items, received, transmitted or stored using the computer systems operated by it, on any digital or analog medium, and present these, except in the case of manifest error.
Article 9 - Indivisibility
The fact that any provision of the Genera Terms and Conditions of Use is or becomes unlawful or unenforceable will in no way affect the validity or enforceability of any other provision of these Terms.
Article 10 - Settlement of Disputes - Applicable Law - Jurisdiction
All disagreements or disputes that arise from these General Terms and Conditions of Use and / or Services, their validity, interpretation, performance or non-performance, are subject to French law, regardless of the country of origin. origin of the User or the country from which the User accesses the https://www.qioz.fr platform and notwithstanding the principles of conflicts of laws.
In the absence of an amicable resolution, the disputes concerning them will be brought before the competent courts of Paris, even in the event of summary judgment, appeal in guarantee or plurality of defendants.
